1Acceptance of Terms
These Terms & Conditions govern your access to and use of the Dev Noctis website and any services we provide. By contacting us, requesting a quote, or engaging us for a project, you agree to be bound by these terms. If you do not agree, please refrain from using our services.
2Services
Dev Noctis provides website design, development and related digital services, including but not limited to business websites, portfolios, e-commerce stores and custom web applications. The exact scope of any project will be agreed upon with the client before work begins, typically outlined in a proposal, quote or written communication.
We reserve the right to refuse or discontinue service for any project that conflicts with our capabilities, values, or applicable laws.
3Payments
Project pricing is communicated upfront based on scope and requirements. Unless otherwise agreed in writing:
- An advance payment may be required before work begins.
- Remaining balances are due as per the milestones agreed with the client.
- Prices are exclusive of any third-party costs such as domain registration, hosting or paid plugins/licenses, unless explicitly included.
- Late or non-payment may result in pausing or halting project work.
4Project Delivery
Delivery timelines are estimated at the start of a project and communicated to the client. Timelines depend on the complexity of the project and the timely availability of content, feedback and approvals from the client's side.
Delays caused by late client responses, incomplete content, or scope changes may extend the original delivery estimate.
5Revisions
Each project includes a set number of revision rounds, as agreed at the time of quoting. Revisions cover reasonable adjustments within the original agreed scope. Requests that significantly expand the original scope may be treated as additional work and quoted separately.
6Intellectual Property
Upon full payment, ownership of the final delivered website design and content created specifically for the client is transferred to the client, unless otherwise agreed. Dev Noctis retains the right to:
- Showcase completed projects in our portfolio and marketing materials.
- Reuse general frameworks, code snippets and techniques that are not unique or proprietary to a specific client.
Any third-party assets (fonts, stock images, plugins, libraries) remain subject to their respective licenses.
7Limitation of Liability
Dev Noctis strives to deliver reliable, high-quality work, but we do not guarantee that our services will be uninterrupted or entirely error-free. To the fullest extent permitted by law, Dev Noctis shall not be liable for any indirect, incidental or consequential damages arising from the use of our services or website, including loss of revenue, data or business opportunities.
8Termination
Either party may terminate an ongoing project with written notice. In the event of termination:
- The client is responsible for payment of all work completed up to the termination date.
- Any advance payments made are non-refundable unless otherwise agreed.
- Dev Noctis will deliver completed work product corresponding to payments received.
9Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with applicable local laws. Any disputes arising from these terms or our services will be handled in good faith, with an attempt at amicable resolution before pursuing formal proceedings.
